Terms of Service

These Terms of Service ("Terms") govern your access to and use of Exiva ("Exiva", "we", "us", or "our"), available at exiva.io. By accessing the site, creating an account, or creating a Radar, you agree to these Terms. If you do not agree, please do not use Exiva.

Your use of Exiva is also governed by our Privacy Policy, which explains what data we collect and how we handle it.

Exiva is a tracking tool for the Tibia Character Bazaar. It lets you browse current and past auctions with advanced filters and, if you sign in, save a filter as a "Radar" so we can alert you when a matching character auction appears.

Exiva is an independent, unofficial fan project. It is not affiliated with, endorsed by, sponsored by, or operated by CipSoft GmbH, the maker of Tibia. We do not sell, buy, broker, or take part in any character auction, and we are not a party to any transaction you make on the Tibia Character Bazaar.

The auction information shown on Exiva is collected from publicly available sources and provided for convenience only. It may be incomplete, delayed, or inaccurate. Always confirm details on the official Tibia website before making any decision.

You must be at least 13 years old, or the minimum age required by the laws of your country, to use Exiva. By using the service you confirm that you meet this requirement.

Browsing Exiva does not require an account. Signing in is only needed to create and manage Radars.

Sign-in providers.You sign in through Google or Discord. We never create, collect, or store passwords — authentication is handled entirely by the provider you choose.

One account per email address.Each email address may be linked to exactly one Exiva account, and each account is tied to the single sign-in provider used when it was created. If you try to sign in with a different provider using an email address that already belongs to an account, the sign-in will be refused. Sign in with the provider you originally used.

Your responsibility.You are responsible for activity that occurs through your account and for keeping access to your sign-in provider secure. If you believe your account has been accessed without your permission, contact us at the address in Section 14.

A Radar is a saved set of filters with an expiration date. While it is active, we check new auctions against it and send you an alert by email, and by WhatsApp if you have confirmed a phone number and enabled that channel.

Best effort, not a guarantee.Alerts depend on systems outside our control, including the availability of the source data and of email and messaging providers. We do not guarantee that every matching auction will produce an alert, that an alert will arrive, or that it will arrive in time for you to act on it. Do not rely on Exiva as your only means of monitoring an auction.

Limits.We may set and adjust limits on how many Radars an account can keep active and how long a Radar lasts, in order to keep the service usable and affordable for everyone.

Expiration and cancellation.A Radar stops checking new auctions once it expires or once you cancel it. You can cancel a Radar at any time from the Radar dashboard.

You agree not to:

• Use automated means to scrape, crawl, copy, or bulk-download Exiva's pages or API beyond normal personal use of the website.
• Create accounts by automated means, create multiple accounts to get around limits, or impersonate another person.
• Interfere with or place an unreasonable load on the service, including attempts to probe, scan, or test the vulnerability of our systems without our written permission.
• Resell, redistribute, or commercially exploit Exiva's data or alerts without our written permission.
• Use Exiva to break any applicable law or the Tibia rules set by CipSoft.

Tibia, its characters, artwork, item images, and related content are the property of CipSoft GmbH and are used here for identification and informational purposes within a fan project. All rights in that material remain with CipSoft.

The Exiva name, interface, design, original text, and software are ours. You may use the service as intended by these Terms, but you may not copy, modify, or create derived works from Exiva's own materials without our written permission.

Exiva depends on third-party services to operate, including Google and Discord for sign-in, our hosting and email providers, and WhatsApp for optional alerts. Your use of those services is governed by their own terms and privacy policies. Exiva may also link to third-party sites, including the official Tibia website; we are not responsible for their content or practices.

We may add, change, suspend, or discontinue any part of Exiva at any time, including features you rely on. We may also perform maintenance that makes the service temporarily unavailable. We will try to give notice of significant changes when it is reasonable to do so, but we are not obliged to.

Exiva is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the service will be uninterrupted, timely, secure, or error-free, or that the auction data shown will be accurate or complete.

Nothing in these Terms excludes any warranty or right that cannot be excluded under the law that applies to you as a consumer.

To the fullest extent permitted by law, Exiva and the people who operate it will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, opportunities, data, or goodwill, arising out of or related to your use of the service. This includes losses connected to an auction you missed, an alert that did not arrive or arrived late, and any decision you made based on information shown on Exiva.

Exiva is provided free of charge. Where liability cannot be excluded, our total aggregate liability to you is limited to the greater of the amount you paid us in the twelve months before the claim, or US$50.

You may stop using Exiva at any time, and you may request deletion of your account and associated data as described in our Privacy Policy. We may suspend or terminate your access if you breach these Terms, if we are required to by law, or if keeping your account active would harm the service or its users. Sections 7, 10, 11, and 14 survive termination.

We may update these Terms from time to time to reflect changes to the service or for legal reasons. The "Effective date" at the top of this page indicates when they were last revised. Continued use of Exiva after a change becomes effective constitutes acceptance of the revised Terms. If you do not agree with a change, stop using the service and request deletion of your account.

These Terms are governed by the laws of the Federative Republic of Brazil, without regard to conflict-of-law rules. This does not remove any mandatory consumer protection you are entitled to under the law of the country where you live, including the right to bring proceedings in your local courts where that right applies.
